Terms of Service

IEP Guardian is designed to help parents of children with disabilities organize documentation, track accommodations, and prepare for IEP and 504 plan meetings. The tool provides organizational features, templates, checklists, and AI-generated summaries to support your preparation.

The service is intended as a preparation and organization aid, not a substitute for professional guidance. Educational, legal, and medical outcomes depend on many factors outside the scope of any organizational tool.

Ivory Digital, LLC expressly disclaims all responsibility for educational, legal, or medical outcomes arising from or related to your use of IEP Guardian, regardless of the nature of those outcomes.

Nothing in IEP Guardian constitutes legal advice, legal representation, medical advice, therapeutic guidance, or professional educational advocacy.

Specifically, IEP Guardian does not:

• Provide legal interpretation of IDEA, Section 504, or any other law
• Guarantee any outcome in IEP, 504, or school disciplinary proceedings
• Provide medical diagnoses or treatment recommendations
• Replace a licensed educational advocate, special education attorney, or therapist

You should consult a qualified attorney, advocate, or medical professional for advice specific to your child's situation.

Use of IEP Guardian does not create any obligation, liability, or duty of care on the part of IEP Guardian or Ivory Digital, LLC.

You must be at least 18 years of age and a parent or legal guardian to create an account. IEP Guardian accounts are for adults managing educational advocacy on behalf of their minor children. Accounts for children are not permitted.

You own your data. Content you create — including accommodation logs, communication records, documents, and notes — belongs to you. We do not claim ownership over your content.

By using IEP Guardian, you grant us a limited license to store and process your data solely to provide the service. We do not use your content to train AI models or for advertising.

You may export or delete your data at any time. See our Privacy Policy for details on how to request data export or deletion.

You agree not to use IEP Guardian to:

• Upload content that violates any applicable law
• Impersonate any person or entity
• Attempt to gain unauthorized access to other users' accounts or data
• Use the service for commercial advocacy or consulting without permission
• Reverse engineer or attempt to extract proprietary software

IEP Guardian is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be error-free, uninterrupted, or that AI-generated content will be accurate or complete.

Ivory Digital, LLC makes no representations or warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of AI-generated content, or compliance with any law or regulation. The entire risk of use rests solely with the user.

AI-generated meeting prep suggestions, talking points, and summaries are starting points for your own research and preparation — not authoritative guidance. Always verify any information with qualified professionals.

To the fullest extent permitted by law, IEP Guardian and Ivory Digital, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

In no event shall IEP Guardian or Ivory Digital, LLC be liable for any educational, legal, medical, or financial outcome — including but not limited to outcomes of IEP meetings, 504 plan decisions, school disciplinary actions, or any legal or administrative proceedings — regardless of whether such liability is based on contract, tort, negligence, strict liability, or any other theory.

Ivory Digital, LLC's total liability to you for any claim arising from use of the service shall not exceed the amount you paid for the service in the three months preceding the claim.

Indemnification: You agree to indemnify, defend, and hold harmless IEP Guardian and Ivory Digital, LLC, and their respective officers, employees, and agents, from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the service or your violation of these Terms.

You may cancel your account at any time from your account Settings. Upon cancellation, you may export your data before your account is deactivated. Deleted accounts and their associated data cannot be recovered.

We reserve the right to suspend or terminate accounts that violate these Terms.

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the service after changes take effect constitutes your acceptance of the updated Terms.

Mandatory Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the use of IEP Guardian shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of Florida. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in class actions, class-wide arbitration, or any other proceeding where a person acts in a representative capacity.

Small Claims Exception. Either party may bring an individual action in small claims court if the claim qualifies under the court's jurisdictional limits.

Informal Resolution First. Before initiating arbitration, you must contact Ivory Digital, LLC and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved within that period, either party may proceed with arbitration.

Arbitration Costs. Each party shall bear its own costs and expenses in connection with any arbitration proceeding. Ivory Digital, LLC shall not be responsible for any arbitration fees, attorney's fees, or other costs incurred by the user.

Opt-Out. You may opt out of this arbitration provision by sending written notice to Ivory Digital, LLC within 30 days of creating your account. If you opt out, disputes will be governed by the Governing Law and jurisdiction provisions below.

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Ivory Digital, LLC is organized under the laws of the State of Florida. By using IEP Guardian, you consent to the personal jurisdiction of the courts of the State of Florida.
